Randolph E. White
OF COUNSEL
Randolph E. White is a commercial litigation, bankruptcy and business attorney with over 25 years of experience in the state and federal trial and appellate court systems. He is Of Counsel to McGivney & Kluger, P.C. and a member of the firm’s general practice group.
Over the course of his career he has represented a broad clientele, from individuals and small businesses to some of the largest financial institutions in the world in civil disputes involving breach of contract, fraud, the UCC, corporate governance and dissolution, construction and real estate, partnership, commercial landlord/tenant, trusts and estates and employment discrimination. Mr. White has also practiced in the fields of creditors’ rights, debtors’ rights, restructuring and bankruptcy law, where he has represented creditors’ committees, trustees, creditors, debtors-in-possession and debtors in a broad range of industries and endeavors. Representative successes include obtaining an over $30 million judgment on behalf of the Committee of Unsecured Creditors of Interstate Cigar Co., affirmed by the United States District Court for the Eastern District of New York in In re: Interstate Cigar Co.,2002 Bankr. LEXIS 781 (Bankr. E.D.N.Y. 2002); recovering for Long Beach Mortgage Company (a division of Washington Mutual Bank) against depository banks, and title companies to substantially mitigate multimillion-dollar loss caused by mortgage broker bank fraud scheme; and reorganizing Gurneys Inn Resort and Spa, Ltd. Mr. White has also represented lenders and other parties in interest in the Spectrum Resources, General Motors and Mervyn’s high profile bankruptcy cases.
Mr. White is admitted to practice in New York State, before the United States District Court for the Eastern and Southern Districts of New York and the United States Court of Appeals for the Second Circuit. He is an active member of the New York City Bar Association, the American Bankruptcy Institute and the Brooklyn Bar Association. He has served as a moot court judge in the New York City Bar Association and Conrad Duberstein (bankruptcy moot court) Competitions. He received his J.D. from Cornell Law School in 1984 and B.A. from St. John’s College, Annapolis, Md. in 1981.
