Kevin E. Young

Kevin Young is a partner based in the Firm’s Boston office.  Kevin has more than twenty-five years of experience in complex product liability litigation, and his practice has focused on the defense of cases involving a variety of pharmaceuticals, toxic materials, industrial machinery and automotive defects.  Kevin has extensive first chair trial experience throughout the country in mass toxic tort cases, and has appellate experience before the Massachusetts Court of Appeals and the First Circuit Court of Appeals.  He has been local, regional and national counsel for pharmaceutical companies and a wide-assortment of companies sued in the asbestos litigation. As a result of his pharmaceutical work and asbestos work, Kevin has a thorough understanding of medical science and has developed trusting relationships with medical professionals who can evaluate the medical issues in myriad types of cases and assist, when appropriate, his clients.

In the Life Sciences area, Kevin has:

  • Represented Sequa Corporation, the alleged successor to several manufacturers of Thorotrast, a radioactive contrast medium.  His client received dismissals in all cases in which he was involved based on various theories, including the Learned Intermediary Doctrine.  Several of those decisions are reported in the Massachusetts Court of Appeals, the United Stated District Court of Massachusetts, and the First Circuit Court of Appeals.
  • Represented, as part of an NCC team, the patent holders of Phentermine in the Fen/Phen litigation.  As part of that team, his clients were ultimately dismissed in thousands of cases when they prevailed in the first Daubert proceeding in MA and thereafter in the Fen/Phen MDL.
  • Represented hospitals in malpractice proceedings.
